By approving this estimate or authorizing work, Customer agrees to all terms below.
1. SCOPE OF REPAIR WORK
Repairs are limited to the specific areas and conditions identified in the estimate. Roofing systems are complex, and the exact source of leaks may not always be fully visible or discoverable at the time of repair.
Contractor will use reasonable professional judgment to address the identified issue but does not guarantee discovery or correction of all underlying or secondary conditions.
2. LIMITED REPAIR WARRANTY (STANDARD)
Unless otherwise stated in writing, Contractor provides a two (2) year workmanship warranty on the specific repair area performed.
This warranty:
- Applies only to the repaired area
- Covers leaks directly resulting from Contractor’s repair work
- Does not extend to other areas of the roof
This warranty is void if:
- The roof is altered, repaired, or penetrated by others in a manner affecting the repaired area
- Damage occurs from storms, hurricanes, or Acts of God
- The roof system fails outside the repaired area
- The structure or underlying system contributes to failure
2A. OPTIONAL LIFETIME REPAIR WARRANTY (LIMITED)
Where specifically indicated in the estimate or invoice as “Lifetime Repair Warranty,” the following terms apply in place of the standard 2-year warranty for the designated repair location only.
Coverage Area
Coverage is strictly limited to the repaired area and extends to a maximum radius of two (2) feet in all directions from the original repair location (“Covered Area”).
Duration
This warranty remains in effect for the remaining service life of the existing roof system at the time of repair, as determined by Contractor in its reasonable professional judgment.
What Is Covered
- Water intrusion (leaks) originating within the Covered Area
- Failures directly attributable to Contractor’s workmanship within the Covered Area
What Is Not Covered
- Leaks or failures originating outside the Covered Area
- General roof aging, deterioration, or end-of-life conditions
- Pre-existing or concealed conditions (including rot, water damage, or structural deficiencies)
- Structural movement or settlement
- Damage from storms, hurricanes, high winds, or Acts of God
- Work, penetrations, or modifications by others
- Mechanical, HVAC, solar, or equipment-related issues
- Drainage issues or water intrusion caused by other areas of the roof
Conditions and Voiding Events
This warranty is void if:
- Any work or penetration is performed in or affecting the Covered Area by others
- The roof is replaced, overlaid, or significantly altered
- The Customer fails to maintain the roof in reasonable condition
- Access is denied for inspection or repair
- Payment for the repair is not made in full
Right to Inspect and Cure
Customer must provide written notice and allow Contractor a reasonable opportunity to inspect and repair before engaging others. Failure to do so voids this warranty.
Exclusive Remedy
Contractor’s sole obligation is to repair the Covered Area. No full roof replacement, cash settlements, or consequential damages are included.
Non-Transferable
This warranty is non-transferable unless agreed in writing.
2B. WARRANTY VOIDANCE – THIRD-PARTY WORK AND ROOF CLEANING
Any warranty provided by Contractor shall be void to the extent the repaired area or Covered Area is affected by:
- Work, repairs, or penetrations performed by others within or affecting the repaired area
- Installation, modification, or servicing of equipment (including HVAC, solar, satellite, or similar systems) impacting the repaired area
- Foot traffic, mechanical damage, or misuse in or around the repaired area
- Roof cleaning methods that may damage the roofing system, including but not limited to high-pressure washing, improper chemical application, or abrasive cleaning techniques
Permitted Work Elsewhere
Work performed on other areas of the roof by third parties shall not void this warranty unless such work directly causes or contributes to a failure within the repaired area.
Contractor Inspection Rights
Contractor reserves the right to inspect and determine whether third-party work or cleaning contributed to any claimed issue.
3. NO GUARANTEE OF FULL LEAK ELIMINATION
Customer acknowledges that:
- Roof leaks may originate from areas not visible during inspection
- Repairs may address symptoms but not all contributing conditions
- Additional leaks may develop in other areas
No guarantee is made that repairs will permanently eliminate all leaks.
4. RIGHT TO INSPECT AND CURE
Customer agrees to provide written notice of any issue and allow Contractor a reasonable opportunity to inspect and repair before hiring others or making a claim.
Failure to do so voids any applicable warranty.
5. LIMITATIONS OF LIABILITY
A. Pre-Existing and Hidden Conditions
Contractor is not responsible for:
- Rot, deterioration, or prior water damage
- Structural deficiencies
- Improper prior construction
B. Below the Roof Deck
Contractor is not liable for damage to:
- Electrical, plumbing, HVAC, or gas systems
- Wiring, conduits, or communication lines
- Any components within or below the roof deck
C. Interior and Cosmetic Damage
Contractor is not responsible for:
- Drywall or stucco cracking
- Interior water damage
- Paint or finish damage
- Damage caused by normal work vibrations
D. Aesthetic Variations
No guarantee is made as to color match or visual uniformity.
6. WEATHER AND ACTS OF GOD
Contractor is not responsible for damage caused by:
- Hurricanes, tropical storms, or high winds
- Heavy rain events
- Any Act of God
7. PAYMENT TERMS
Payment is due as stated in the estimate. Failure to pay:
- Voids all warranties
- May result in collection action and additional costs
8. DISPUTE RESOLUTION
All claims are subject to Florida Chapter 558.
Disputes shall be resolved as follows:
- Mediation
- Binding arbitration (AAA), if necessary
Venue: Palm Beach County, Florida
Prevailing party is entitled to attorneys’ fees.
Both parties waive jury trial where permitted.
9. INSURANCE AND ACCESS
Customer agrees to:
- Provide reasonable access for inspection or warranty work
- Cooperate with Contractor and its insurers in the event of a claim
10. ENTIRE AGREEMENT
This document, together with the estimate, constitutes the entire agreement. No verbal representations are binding.
